Question by aliveandbreathing: In the state of Ohio, is it legal for a 23 year old to have sex with a 16 year old if both parties consented?

I need to know that a 23 year old cannot be arrested or sent to jail for having sex with a 16 year old. The age of consent in Ohio is 16, but I just want to be sure that the 23 year old cannot be punished in any way if both parties consented to sex.

Depends. Generally speaking, yes; except in cases where the 16-year-old cannot consent on the basis of mental condition, student-teacher relationship, etc.
